STATE CONTROL (SUPERVISION) OVER HEALTHCARE ORGANIZATIONS’ ACTIVITY RELATED WITH THE TURNOVER OF NARCOTIC MEANS AND PSYCHOTROPIC SUBSTANCES

There are more than 29 thousand objects in Russia, conducting operations connected with the turnover of narcotic means, psychotropic substances and their precursors. Control (supervision) in the sphere of the turnover of narcotic means, psychotropic substances and their precursors has national sense. In Russian Federation measures of control (supervision) in the sphere of the turnover of narcotic means, psychotropic substances and their precursors are fixed in Russian law as well as in international acts. Issues of control (supervision) in the sphere of the turnover of narcotic means and psychotropic substances (including license inspection), are regulated by the Federal Law of 26.12.2008 No. 294-FZ “On legal entities and private entrepreneurs’ rights protection in performance of state control and municipal control”. Despite the fact that LAW No. 294 does not distinguish between the terms “state control” and “state supervision”, in practice and science literature these kinds of inspecting activities have specific meanings. In our opinion, Law No. 294-FZ regulates issues of state supervision performance, as subjects of such kind of state activities have jurisdictional power. State control in the sphere of the turnover of narcotic means and psychotropic substances may be conducted in the forms of scheduled and unscheduled inspections.
